AGREEMENT, ACKNOWLEDGEMENT, AND ACCEPTANCE OF TERMS

These Terms of Use ("Terms") govern your access to and use of our services, interfaces, and properties, which include but are not limited to websites, mobile applications, software, email, social media, and any other service or product offered by Muni Health (collectively the "Service") that are owned or controlled by Muni Health, Inc. ("Muni Health," "we," "us," and "our").

These Terms affect your legal rights, responsibilities, and obligations; govern your use of the Service; are legally binding; limit Muni Health’s liability to you; and require you to indemnify Muni Health and settle certain disputes through arbitration. Your acceptance of, and compliance with, these Terms is a condition to your use of our Service, website, and online platforms (collectively, the "Site").

We reserve the right to change these Terms at any time and at our sole discretion. Any changes to the Terms will be effective immediately upon posting, and you agree to the new posted Terms by continuing your use of the Service. It is your responsibility to check periodically for any changes we may make to these Terms. These Terms are written in the English language. We do not guarantee the accuracy of any translated versions. To the extent any translated versions of these Terms conflict with the English version, the English version shall control.

Our Site and Service are only for users who are eighteen (18) years of age or over. If you are under the age of 18, please do not attempt to register with us or provide any personal information. If we learn that we have collected personal information from someone under the age of 18, we will promptly delete that information. If you believe we have collected personal information from someone under the age of 18, please contact us.

By clicking "accept" or otherwise using the Service, you acknowledge that you have read, understand, and accept all terms and conditions contained within these Terms and our Privacy Policy. You agree that information provided by you in connection with our Service is governed by our Privacy Policy, which is incorporated into these Terms. You further agree that you are at least the legal age of majority in the jurisdiction in which you reside and that these Terms apply to you, your dependents, and any other person with access to your Muni Health Account (collectively "you" and "your"). We may, in our sole discretion, terminate your access to all or part of our Site and Service at any time, with or without cause, and with or without notice.

If you do not agree to be bound by these Terms, or if you are under the age of eighteen (18), you are not authorized to access or use this Site or our Service and must immediately exit the Site.

MUNI HEALTH DOES NOT PROVIDE MEDICAL ADVICE, MEDICAL SERVICES, OR MEDICAL CARE.

The content of the Site and the Service, including but not limited to text, copy, audio, video, photographs, illustrations, and graphics, is for informational purposes only and does not constitute professional medical advice, diagnosis, treatment, or recommendations of any kind by Muni Health. Always seek the advice of qualified health care professionals with any questions or concerns regarding your individual needs and any medical conditions, and before stopping, starting, or modifying any treatment.

MUNI HEALTH’S SITE AND SERVICE ARE NOT FOR MEDICAL EMERGENCIES OR URGENT SITUATIONS. IF YOU ARE EXPERIENCING A MEDICAL EMERGENCY, YOU SHOULD DIAL "911" IMMEDIATELY.

SITE ACCESS, SECURITY, AND RESTRICTIONS

To access the Site and the Service, you represent and warrant that you are older than eighteen (18) years. You agree to create your Muni Health Account ("Account") truthfully, providing accurate information including but not limited to your name, mailing address, phone number, and email address ("Muni Health ID"). Your Muni Health ID and Account are personal to you, and you are solely responsible for maintaining their confidentiality and for all activities that occur under your Muni Health ID or Account. You agree to notify Muni Health of any unauthorized use of your Muni Health ID or Account immediately. Access to the Site may be revoked by Muni Health at any time, with or without cause.

You may not use any scraper, crawler, spider, robot, or other automated means to access or copy data from the Site. Violations of system or network security may result in civil or criminal liability.

ELECTRONIC COMMUNICATIONS

When you use the Site or Service, or send emails and messages to us, you are communicating with us electronically. You consent to receive communications from us electronically. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

Muni Health may contact you by phone, mail, or email to verify your account information. If you do not provide the requested information within fourteen (14) days, we reserve the right to suspend, discontinue, or deny access to the Site and Service.

OWNERSHIP OF SERVICE

The Service and all content, including but not limited to all copyrights, patents, trademarks, service marks, and trade names, are proprietary and owned or controlled by Muni Health, our licensors, and certain third parties. All rights not expressly granted to you are reserved and retained by Muni Health and its licensors.

COPYRIGHT POLICY

Muni Health complies with the Digital Millennium Copyright Act (DMCA). Any notice or counter-notice submitted must be truthful and submitted under penalty of perjury. We may share notices and counter-notices with others, and by submitting any notices, you agree to have no expectation of privacy in your submission.

DISCLAIMER AND LIMITATION OF LIABILITY

The Site and all services, information, goods, and materials made available through the Site are provided "as is" without any express or implied warranties of any kind. We disclaim all statutory or implied warranties, including but not limited to those of satisfactory quality, merchantability, fitness for a particular purpose, non-infringement, and title. We make no warranty that the Site or any part of it will be accurate, complete, or error-free.

You agree that Muni Health shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with your use of the Site.
